By continuing to use our services, you confirm that you have read and agree to our terms of use available for you here. U.S. Personal Shopper Service Terms of Use I. Membership and Fees 1. The US Personal Shopper service is an exclusive membership benefit. Only registered members have access to this service. 2. Service Fees and Charges are applicable. Please refer to the US Personal Shopper Service Fee Schedule for all current and applicable charges. 3. Fee and Price Changes : The US Personal Shopper reserves the right to increase or change Service Fees and Shipping Prices at any time. The current applicable fees and prices will be reflected in the US Personal Shopper Service Fee Schedule and the invoice provided to the member. By settling the invoice, the member agrees to the current fees and prices. II. Pricing, Payment, and Order Placement 4. The total invoice for any request will include the item purchase price, US Personal Shopper service fees, U.S. Sales Tax (where collected by the U.S. retailer), and any shipping-related fees. 5. In the event that a U.S. retailer (especially sellers from platforms like eBay, Mercari, or Poshmark) does not collect U.S. Sales Tax, the US Personal Shopper service is required to remit applicable U.S. Sales Tax in California. 6. Our member support team will send you an invoice for your request. You have 2 days to settle the invoice. 7. Invoice Review and Responsibility : Members must carefully review all item details on their invoice before making payment. This includes the style number, color, size, quantity, and any other relevant information. 8. Invoice Settlement & Availability : Item availability is NOT guaranteed, as items are NOT put on hold until payment is received. 9. Consequence of Late Payment : Failure to settle the invoice within the 2-day window will result in the automatic cancellation of the US Personal Shopper request. A new request must be submitted, and pricing/availability is NOT guaranteed. 10. All invoice amounts are in USD and must be paid in USD . 11. Requests over $200 must be paid by bank/wire transfer. Members are responsible for the full invoice amount and any bank/transfer fees imposed by their local bank. 12. Modification and Cancellation : NO US Personal Shopper service requests can be modified or canceled once the order is placed with the retailer. 13. Bidding and Auction Sites : The US Personal Shopper will NOT accept requests for items requiring bidding (e.g., eBay, Goat, Stock X). We can only facilitate the direct purchase of items. 14. Prohibited Purchases (Financial/Digital Items) : The US Personal Shopper does not accept request purchases of any digital or virtual items (including, but not limited to, Apple , Amazon , Visa , or Mastercard virtual gift cards), money orders, or any form of digital cash. 15. Account Usage : We will NOT use a member's personal retailer account or personal retailer coupon(s) for any US Personal Shopper service request. 16. Discounts : Member-provided discount coupons from U.S. retailers may be used upon placing the order, but this is subject to the U.S. retailer’s discretion. 17. Confidentiality : The US Personal Shopper uses confidential information for purchases (e.g., email address, billing zip code, retailer’s invoice). We will NOT share this confidential information with the member. III. Retailer, Warehouse, and Shipping Operations 18. The US Personal Shopper acts as a third party and abides by the U.S. retailer’s terms of use and shipping policies. 19. Processing Times (Retailer) : U.S. retailer’s order processing and shipping timelines are beyond our control. We cannot guarantee delivery dates. U.S. retailers rarely give prior notice for delays. The US Personal Shopper can follow up with the retailer but must solely rely on their published timelines. 20. Order Numbers : We will provide the order number(s) to the member. The order number is not a guarantee of item availability until the item has been shipped out by the U.S. retailer. U.S. retailers can cancel purchases even after an order number is provided due to item unavailability or inventory issues, especially during sale events. 21. Local Transit Liability and Insurance : The US Personal Shopper has NO liability for orders delivered by local courier (such as USPS) to our warehouse, especially if the order is delivered to the wrong address, marked as delivered but not received, or lost in transit. The US Personal Shopper team will reach out to the U.S. retailer for item replacement, which is subject to the retailer's discretion. 22. High-Value Purchase Risk and Insurance : For any single item purchased with a value exceeding $500 USD , the member acknowledges and agrees that the risk of damage or loss during local shipping transit is borne entirely by the member. The US Personal Shopper strongly advises members that the only guarantee for replacement or refund for such a high-value purchase lost or damaged during local transit is by purchasing shipping insurance offered by the U.S. retailer during the initial checkout process. 23. Gift Wrapping : US Personal Shopper opens and inspects packages received at the warehouse. We will NOT accept a retailer's gift wrapping option. Gift wrapping services can be requested through our team, and a service fee applies. 24. Warehouse Processing Time : The US Personal Shopper has a 2 business days turnaround processing time after a member's order is received at the warehouse. 25. Warehouse Schedule : The US Personal Shopper warehouse is closed on weekends and holidays . Orders received during this time will be processed after the next business day once operations resume. 26. Members have access to 20 days FREE storage of their items, starting from the date the package was delivered to our warehouse. 27. Members have access to FREE consolidation service for their items. 28. Shipping Partners : US Personal Shopper uses exclusive shipping partners: FedEx International for international shipping and UPS for local shipping. NO other carriers may be used. We will use the US Personal Shopper's corporate accounts with FedEx and UPS for all shipments. 29. Chargeable Weight : Air cargo chargeable weight is based on the package’s actual or volumetric weight (package dimensions in inches L x W x H), whichever is higher. The actual shipping cost can only be determined once your order is received at our warehouse. 30. Address Update : Members must update their preferred shipping address and contact number to avoid shipping delays once their order is received at the warehouse. 31. Shipping Invoice : A separate invoice for international shipping fees, including handling fees, will be sent after receipt of your order. IV. Customs, Delivery, and Liability 32. International Shipping Delays : The US Personal Shopper has NO control over international shipping delays from FedEx or local shipping delays from UPS . All delivery dates are subject to the delivery timeframe established by FedEx and UPS . 33. Customs Delays : Any customs delay at the destination country is beyond the US Personal Shopper's control. We can only communicate and coordinate with FedEx regarding the status of the shipment. 34. Customs Valuation : The US Personal Shopper will declare the actual amount of the item(s) purchased and will NOT reduce the amount for Customs Duties, Taxes, and VAT purposes. 35. The shipping invoice will include the destination country’s customs duties, taxes, and VAT where applicable. As a company, the US Personal Shopper is required to ship all orders as Delivered Duty Paid (DDP ) when applicable. NO orders will be shipped without Customs Duties, Taxes, and VAT being paid prior to shipping. 36. Claiming Discounted Duties, Taxes, and VAT a. Advance Payment Basis : All DDP advance payments are calculated using maximum standard statutory rates and include non-refundable carrier brokerage and disbursement fees. b. Customer Documentation : Customers may submit documentation (e.g., eligibility certificates, origin statements, or declarations) to support a claim for a discounted rate. US Personal Shopper will include this documentation with the shipment. c. Final Ruling & Refund : The final decision on granting any discount rests solely with the destination country's Bureau of Customs. If a discount is officially granted, the difference between the advance payment and the final, confirmed official charge (excluding non-refundable brokerage fees) will be refunded. US Personal Shopper is not responsible for the approval or denial of any claim. 37. Prohibited Goods : The US Personal Shopper will not accept requests for items that are illegal, hazardous, or restricted for export from the U.S. or import into the destination country. The member is solely responsible for ensuring the requested item complies with all applicable U.S. export laws and the import laws of the final destination. 38. Liability for Warehouse Loss/Damage : The US Personal Shopper will exercise reasonable care for items stored in the warehouse. In the event of confirmed loss or damage attributable to our team's negligence prior to shipping, our liability shall be limited to the item's purchase price . 39. Liability in Transit (Mandatory Insurance) : Once an order has been handed over to the international shipping carrier, the US Personal Shopper's liability for loss or damage ceases. For all shipments with a total item value exceeding $500 USD (or a different threshold determined by the US Personal Shopper team), the purchase of additional shipping insurance is MANDATORY and will be included in the international shipping invoice. The Member acknowledges that failure to purchase the mandatory insurance or choosing a lower-tier insurance voids any claim against the US Personal Shopper team for loss or damage during international transit. V. Refunds and Returns 40. Non-Refundable Fees (Online) : For all online purchase requests, all related US Personal Shopper service fees are NON-REFUNDABLE once service has started (i.e., once the purchase invoice has been paid). 41. Non-Refundable Fees (In-Store) : For all in-store purchases, the US Personal Shopper service fee is NON-REFUNDABLE regardless of item availability or purchase outcome. 42. Final Sale Items : No returns or refunds will be provided for items that are on FINAL SALE (as designated by the retailer). 43. Retailer Cancellation : US Personal Shopper service related fees are NOT refundable if the retailer cancels our order after it is placed. In all cases, the US Personal Shopper can only refund the member what is refunded by the U.S. retailer to the Service. 44. Member-Requested Return : If a member requests to return item(s) after the order has been placed, US Personal Shopper service related fees are NON-REFUNDABLE . 45. Return Assistance : We can assist with the return of your orders; a service fee applies. Returns are subject to the retailer’s return policy on the purchased items. 46. All associated fees with the return, including return shipping and insurance fees (if required by the U.S. retailer), will be charged to the member. 47. Refund Process : The retailer return process may take up to 30 days to be completed. The refunded amount will be credited to the member's US Personal Shopper account for use on shipping fees unless the member requests otherwise. Refunds CANNOT exceed the total amount refunded by the U.S. retailer to the Service. VI. General Legal Provisions 48. Right to Refuse Service : The US Personal Shopper has the right to refuse service to members as per our company policy and discretion. 49. Governing Law and Jurisdiction : These Terms of Use and the relationship between the Member and the US Personal Shopper shall be governed by the laws of the State of California , without regard to its conflict of law provisions. The Member agrees to submit to the personal and exclusive jurisdiction of the state and federal courts located within the County of Los Angeles, California . 50. Force Majeure : The US Personal Shopper shall not be liable for any failure or delay in performance of its obligations under these Terms if such failure or delay is due to events beyond its reasonable control, including but not limited to, acts of God , war , terrorism , embargoes , fire , flood , accident , government intervention , labor strikes , or major disruptions to carrier networks (Force Majeure Event ). 51. IV. Warehouse Services and Item Handling 13. Warehouse Processing : The Company will process your Package within 2 business days from the package arrival date. Package details will be emailed to you, and you will have the option to ship or consolidate. 14. Warehouse Schedule : The Company warehouse is closed on weekends and holidays . Packages received during this time will be processed on the next business day. 15. Repackaging : As an exclusive member benefit, We will repackage your Shipment to ensure it is fit for international shipping and remove all unnecessary packing materials for more cost-effective shipping. Repackaging will not involve taking out items from the original retailer’s packaging. 16. Photos : Free overview photos (3) of your Package are included. Detailed photo/s (i.e., individual item photo, brand, size, etc.) can be arranged on request, and a service fee applies (refer to Add-Ons). 17. Consolidation : Consolidation services are included with membership (excluding Consolidated Boxes Fee). We consolidate per Package into a bigger box, NOT per item. Shipment may be split into separate boxes, depending on size, quantity, and total amount. V. Storage and Abandoned Packages 18. Free Storage : Free storage facility is exclusively offered to members (refer to membership plans for the number of allowed free storage days). 19. Storage Expiration : The Company will send an email notification ten (5) days before your free storage expires. You may proceed with shipping or extend storage up to five (5) days with the applicable fee (refer to Add-Ons). 20. Abandoned Shipments : Should your free storage day expire, you must immediately ship your Package. Any Package or Shipment that We are unable to ship due to reasons including, but not limited to, failure to pay or take delivery, will be considered abandoned. 21. Disposal of Abandoned Packages : All abandoned Packages or Shipments will be discarded, destroyed, or auctioned at the Company's sole discretion. Carrier Account : The Company will use its corporate accounts with shipping carriers; we will not use a Member’s personal account. 25. Chargeable Weight : Shipping chargeable weight is based on the Package's actual or volumetric weight (package dimensions in inches L x W x H / Carrier factor), whichever is higher , then rounded up to the highest pound (if applicable). Shipping rates are subject to change without prior notice and are not guaranteed, except when the shipping invoice has been issued and paid within 2 business days . 26. Shipping Invoice and Payment : All customs duties and taxes applicable on the total value of goods (goods price, sales tax, and shipping charges), and any third-party charges, are included in the shipping invoice. You agree to pay all applicable shipping fees and charges within 2 business days of receipt of the invoice. 27. Prohibited Items These are goods and commodities that are strictly prohibited or forbidden to be exported from the U.S. to any destination country or territory, and prohibited or forbidden to be imported into Australia. READ MORE + Items with restrictions or allowed under certain conditions Animal Skins, Non-Domesticated If the animal skins are covered by the Convention on International Trade of Endangered Species (CITES), they will be seized by Customs unless a valid export permit and import permits are in place at the time of importation and are presented to Customs at such time. Clothing All clothing must contain labels. The labels must state the material composition and country or territory of origin. This label must be sewn into the garment, where the customer can see the markings if the garments are packaged. If the packaging is not transparent, the markings must also be on the packaging. Coffee Green coffee beans require an import permit from the Australian Quarantine and Inspection Service. Compact Discs These items are subject to censorship for objectionable content. Cosmetics Shipments of cosmetic products more than 250mg/kg of lead, require approval from the Ministry for Justice and Customs. This does not apply to those designed for use in hair treatments. Dairy Requires an import permit from the Department of Agriculture, Forestry and Fisheries. Films These items are subject to censorship for objectionable content. Food Restrictions depend on the type of food product. All goods containing meat, dairy, fish, and bee products require permits to import. Quarantine charges apply for food importation. Restrictions in relation to commerce marking also apply; packaging must identify the manufacturer, distributor, importer, quantity, ingredients, and country or territory of manufacture. Any shipments that arrive in old fruit boxes will be repacked. The boxes are then destroyed. Clearance delays will occur. Charges for the quarantine inspection of food are billed to the consignee. Suspicious foods are fumigated by Australian Quarantine Authorities. The minimum quarantine fee is $36.00 Australian dollar (AUD). Goods of Taiwan Origin Increased quarantine measures are being applied for products produced in Taiwan as a result of the confirmed outbreak of Foot and Mouth Disease. Import Permits and applications for products with more than 10% of dairy content; semen, embryos and other biological products of susceptible species are to be assessed and appropriate measures or suspension in line with new requirements as a result of the outbreak will be imposed. All affected business will be informed of changes affecting their Import Permits. Further, import for the following products will be assessed on a case by case basis depending on manufacturing processing and other treatment being sufficient to manage the risk of Foot and Mouth Disease: Used farming equipment Saddlery, harnesses & tacks Scoured wool, animal hair and leather products Processed canned and dried pet food Biological Products from non-susceptible species Processed meat of dairy products (for example, chocolate and confectionary, highly processed cheese; shelf stable hermetically sealed/retorted meat and dairy products) For further information, please click here. Goods of U.S. Origin Australian Customs may require a Certificate of Origin for goods claiming preferential terms under the U.S. - Australia Free Trade Agreement (AUSFTA). The goods must be wholly obtained or produced in the U.S. If U.S. origin is not stated on the commercial invoice at time of importation, preference will not be claimed and the standard schedule duty rate will apply. Jewelry Jewelry Shipments with a value less than $1000.00 AUD require Evidence of Price Paid or Sale. This can be in the form of Bank Statements showing proof of payment for the goods, or Credit Card statements or other Receipts showing the actual monetary transaction for the goods. Medicine The importation of medicines into Australia is regulated under the "Therapeutic Goods Act". If the medicines are not registered with the "Therapeutic Administration" then they are not permitted entry into Australia. Permits to import are required for certain goods such as steroids. Personal imports of prescription medicines can be imported if the importer is a person, the supply is for less than 3 months and they have a prescription from an Australian doctor. Nutritional Supplements A full listing of ingredients is required on the invoice. Customs and Quarantine will hold all shipments until ingredients can be verified. Shipments containing ingredients that cannot be verified or are prohibited will be seized by Customs. Quarantine inspection charges will apply. The list of prohibited ingredients can be found in the Australian Government - Department of Health website Personal Effects Personal Effects are classified as used items (owned for a minimum of 6 months) intended for the consignee's personal use. Any items intended for any other use, such as wholesale or retail sales, business purposes, or for distribution are not considered personal effects and cannot be shipped on this basis. "Personal Effects" must be clearly stated on the invoice and goods description. A confirmation that the goods are older than 6 months and that they are intended for personal use only A photocopy of passport or ID card Any items intended for any other use, such as wholesale or retail sales, business purposes, or for distribution are not considered personal effects and cannot be shipped on this basis. Personal effects shipments are not allowed in combination with Return Services. Excisable Goods For example - perfume, alcoholic drinks, tobacco), medicine, and perishable food can not be cleared as personal effects Pharmaceuticals Pharmaceuticals require an import permit from the Therapeutic Goods Administration (TGA). Shoes According to the Trade Marking requirements, shoes must be individually marked in a permanent manner stating the country or territory of origin and material(s) content. Software All software shipments must invoice the value of the compact disc (CD) or diskette and the value of the intellectual property or programming. If the CDs or diskettes are blank, the description on the invoice must mention the fact. If the invoice does not indicate the intellectual property or programming value, then the shipment may be subject to further Customs checks and subsequent delays. Straw Straw is strictly prohibited; non-compliance results in longer delays. All packages containing straw will be held and the straw removed. The importer bears the expense. Delays ranging from 48 hours to 2 weeks will occur. The cost of removing the straw and the subsequent delays are based on the size of the package. Tableware Ceramic tableware may be delayed for lead cadmium testing. Telephone Equipment Portable telephones require an import permit. Textiles Textiles must be labeled with the composition of fabric and country or territory of origin. Tires The manufacturer must issue a certificate certifying that the tire is free from mosquitoes and/or their larvae. Tobacco Products Tobacco products now require written permission to be shipped must have a valid import permit before goods arrive in AU. Certain types of tobacco products are exempt from this regulation (smokeless tobacco, cigars and unmanufactured tobacco). Restricted Items Prohibited Items Strictly Forbidden or Prohibited Items in Australia Alcoholic Beverages Import of Alcoholic beverages into Australia is permitted via ISC contract service Importation of Alcohol products to Australia does not include the de-minims value rule, All Alcohol products are subject to high rates of duties rates (excise and WET tax) and GST upon importation at the Australian Border regardless of the importation value declared. Asbestos products and/or products containing Asbestos Due to a growing number of asbestos products and/or products containing asbestos being imported illegally, the Australian Government has now increased border targeting of these products in an effort to reduce instances of these prohibited imports. The Australian Border Force (ABF) is targeting specific import tariff classification codes linked to potential asbestos products and/or products containing asbestos. The tariff classification areas include but are not limited to the following: Mineral and chemical products Plastic and rubber products Ceramic and glass products Metal products Machinery and electrical products and components, incl. automotive and similar products As a result of this heightened enforcement, importers should undertake due diligence with manufacturers and suppliers of any goods or products suspected of containing any level of asbestos. Where applicable, importers should also have a statement on the commercial invoice indicating "asbestos-free materials". Electronic Cigarette / Vaping Product Electronic Cigarettes can only be shipped with an International Special Commodities (ISC) contract. Electronic Cigarettes can only be imported into Australia for personal consumption only-not for commercial purposes. From the 1st October 2021, all nicotine for human use, including vaping products that contain nicotine, such as nicotine e-cigarettes, nicotine pods and liquid nicotine, will be contained within Schedule 4 (prescription only medicines) of The Poisons Standards and will be regulated at the border by the Therapeutic Goods Administration (TGA) Under the scheme, patients can order a maximum of 3 months supply at one time and all importations must be supported by a valid prescription from an Australian medical practitioner at the time of import Any imports which are not supported by a valid prescription or are in excess of the prescribed amount may be assessed by the TGA to be unlawful under the TGA Act 1989 and may be seized as prohibited imports under the Customs Act 1901 A Commercial Invoice is required. These forms of glycol are commonly used in pharmaceutical formulations and are not controlled. Liquid nicotine is scheduled as a 'Schedule 7 Poison' under the Standard for the Uniform Scheduling of Medicines and Poisons (SUSMP). As such, it is considered a substance with a potential for causing harm which requires special precautions in manufacture, handling or use. Other substances listed in Schedule 7 include chlorine and arsenic. The listing of a poison in Schedule 7 does not usually justify an import prohibition. The Department of Health and Ageing (DoHA) is responsible for the government policy on such issues and advised that all States and Territories have domestic controls on the sale of these products and they are prohibited for commercial purposes. Knives The consignee must obtain an import permit for shipments of daggers or double-edged or sharp, pointed stabbing instruments. Concealable knives are prohibited and will be seized by Customs. Laser Products High-intensity laser pointer shipments are prohibited. To import a laser pointer stronger than 1mW, the importer will have to obtain police authorization from the relevant state or territory police force prior to applying for an import permit. Plants Living plant material requirements depend on the plant species, country or territory of origin, and will require a valid Import Permit. Depending on the plant species relevant import and export CITES permits may be required. Accompanying documentation (for example, packing list, Phytosanitary certificates, CITES certificates, invoices etc) and labels on the consignments must correspond and the documentation should clearly identify the plants by their botanical names. All plant material must be free from soil, disease symptoms and other extraneous contamination of quarantine concern. Products Made in Iran Products made in Iran are prohibited in our service due to a current embargo. Smoked Salmon Smoked salmon is prohibited. Toy Guns Any form of toy gun or gun replica is prohibited. Watches The Department of Commerce requires that the watch, the watch housing and the watch's movement be individually labeled with the country or territory of origin if they are not all made in the same country or territory. If each item is made in the same country or territory only the case needs to be marked with the country or territory of origin.
